MoserBaer has sued SeventyMM for Rs. 50 Crores/ lawsuit for ‘violating’ its ‘sole and exclusive video rental rights’.
In its petition, Moser Baer, which has around 10,694 film titles, alleged that Seventymm Services — which provides DVDs on rent and online downloading of movies — was offering films without any authority, as it (Moser Baer) has the sole right to distribute to "third parties and their members".
Moser Baer further said that Seventymm was offering some popular Bollywood movies for which it (Moser Baer) has acquired "sole and exclusive video rental rights". The titles are Jab We Met, Kabhi Haan Kabhi Naa, Yuva, Shaurya, 36 China Town, Garam Masala, Hungama, Halla Bol, Apna Sapna Money Money etc. – source
Does this mean that apart from MoserBaer, nobody else can rent videos (for video rental rights owned)? In that case, is MoserBaer really working on it’s operations to ensure that the vides that they own are available legally as well?

I would be interested to see what would be response of SeventyMM. I am surprised how SeventyMM didnt see it coming if whatever posted here is true to go by..
On seeing the scale of SeventyMM operations I always thought .. Seventymm must had tie up with the Video Cos.. coz .. its clearly written on each CD.. RENTING NOW ALLOWED and blah blah blah
Hope.. others dont follow MOSERBAER example.. Goodluck SeventyMM.
“Content” in any form is a very dangerous game. There are lot of legal intricacies in dealing with content. Of course, like in case of any other attribute, nobody notices or sees these issues till a “critical mass” of operations is reached, and a crical-mass of revenue-stream is reached. “Content brokerage & arbitrage”, clearing-houses, settlement-agencies, liaison agencies exist for this purpose. The intellectual property / copyright / distribution protection/rights have lot of jurisdicational provisions, caveats, exceptions to the standard disclaimer that we see. There are lot of transitive-closures applied on rights, and having clear end-to-end visibility on Content’s ownership or rights (of various forms), isn’t a easy thing. It’s a bit surprising that 70mm didn’t see it coming… (which I doubt), but I think there’s nothing that an out-of-court settlement can’t settle.
Seventymm management is too smart n clever to be threatened with this lawsuit, they have successfully raised millions of $ in 3 rounds without much traction in their site.
They must have made lot f money by circulating cheap dvds from moser baer and i am sure they did it deliberately thinking they would go unnoticed since packing box has 70mm branding.
Now I have realised that they have completely taken off all moser baer stocks from their website….
its surprising moserbaer woke up late. anyways thanks to MB for bringing down the prices. dvds are more affordablem and with such huge catalouge my monthly quota dosent hurt. being always inclined to buy my own copies have tried out amazon, ebay also indian sites wbemallindia recently induna.com and shemaroo. did subscrobe for for rental plan with bigflix & seventymm but the dealy in delivery is pathetic.
looks tough with moser bear pulls seventymm & bigflicks. the titles cannot be ignored. also few retail startups seems to be doing good. dont know if fund managers have marked them, but looks to susceed.
one more flaw with rental business is they seem to ignoring the huge (read somewhere 25 million) indian diaspora, the numbers are to big to be left out. annual export sales of movies is around 10,000 crores.
Hi Sanjeev,
This is interesting.. Can you explain this in detail???
Thanks,
Sweety
Now this is real BAD NEWS. Recession and this suit will surely bring the curtain of seventymm down. Always new online rental will not work for India.
any update on the law suit. I have seen few Moser Baer titles on their page lately.
